Labour Appeal Court sink Maluti-A-Phofung days before local government elections

Bloemfontein – The Labour Appeal Court has refused Maluti-A-Phofung Local Municipality leave for appeal judgment in the SAMWU matter.

Earlier in the year, 27 May 2026, Labour Court Judge RN Daniels dismissed an application for leave appeal by MAP LM.

On Tuesday, 29 September 2026, Justice Nkuthwa-Nkontwana JA, Gwamana AJA, and Moshoana AJA refused and delivered the blow.

“Having read the petition and considered the matter, the panel has made the following order:

  • condonation granted,
  • the petition for leave to appeal is refused with no order as to costs.

This relates to an attempt by the municipality to reverse appointments of 183 employees.

The municipality keeps feeding lawyers money instead of addressing more concerning issues.

Tseko Mokoena from SAMWU could not be reached for a comment.

In other news, It’s just a month since Free State High court ruled in favour of Norman Selai and the FSPG is yet to release a statement.
