Another legal blow for MAP LM as Labour Court delivers damning judgment

Bloemfontein – The Maluti-A-Phofung Local Municipality (MAP LM), based in QwaQwa, has suffered yet another legal setback following a damning judgment by the Labour Court.

On Thursday, 27 May 2026, Judge RN Daniels dismissed the municipality’s application for leave to appeal, with costs.

Daniels did not mince his words.

“The applicant made sweeping allegations regarding the central issue in the dispute, relying on two documents: the staff establishment and approved annual budget,” said Daniels.

But it gets worse for Maluti-A-Phofung. Wait for it, you got to love the Municipality.

“However, when its allegations were disputed, the applicant failed to produce the documents.”

Daniels went back to a basic principle of law before dismissing the application.

“It is an established rule of evidence that when the terms of a written document are in issue, the document should be produced, whether this be original or a copy.”

The ruling follows an earlier judgment in favour of SAMWU, adding to a growing list of legal defeats for the municipality.

For many residents of QwaQwa, the judgment is yet another reminder of a municipality struggling with governance and accountability.

Residents deserve better and continue to be failed by the very leaders they elected to serve them.

In other developing news, a foreign national is being supplied by the municipality with fuel.
