KuGompo – Julius Malema launched a scathing attack on Magistrate Twanet Olivier after being sentenced to five years of direct imprisonment in a case that has stretched since 2018.
The court found Malema guilty on five charges linked to the firing of a rifle during a political rally. His co-accused, bodyguard Adriaan Snyman, was acquitted.

Moments after the sentence was handed down, Malema’s legal representative, Advocate Laurence Hodes, immediately applied for leave to appeal in terms of the Criminal Procedure Act.“Application to appeal in terms of the provision of Section 309(1), 309B of the Criminal Procedure Act 51 of 1977 provides that we can commence immediately…”
Hodes argued that no directly comparable precedent exists for celebratory gunfire cases and cited the case of Oscar Pistorius in support of a lesser sentence.

The State, represented by prosecutor Joel Ceaser, opposed the application, saying there were no reasonable prospects of success.

In a separate ruling, Olivier denied leave to appeal against conviction, but granted leave to appeal against sentence.

Outside court, Malema emerged furious, accusing Olivier of racial bias and branding her “a racist of note.”
