Bloemfontein — As we continue to open the Pandora’s box of unlawful actions by Dr Masego Tshabalala, as per the Free State High Court judgment, Joyce “Pretenders” Mathae’s failure as an appeal authority cannot exonerate her.
Lawrence Msinto was first terminated on 15 May 2023 for absconding between 10 February and 10 March 2023.
This is the period that the Free State High Court declared Dr Tshabalala did not have the authority to act, and ultimately set aside her “actions and decisions”.
On 1 June, Msinto made his representations to Mathae, who was MEC for Community Safety, Roads and Transport at the time and her office received though they allegedly denied having received his presentation.
Five days later, on 6 June, he received another termination letter from Dr Tshabalala, rescinding the letter she had sent on 16 May and calling it an “error”.
He was then terminated for allegedly absconding in September 2022, with the termination being done on 6 June but made retrospective to October 2022.
Msinto took the department to the bargaining council and won but he is at home because someone with bottomless budget keeps appealing. This are the same people handling Dibuo Mapitle’s mater.
These are people entrusted with power, and they are not only failing; they are also abusing it.
Now, with Mathae having failed Msinto and Selai as MEC, the question is: Who is going to implement the High Court judgment?
Failure to do so could lead to contempt proceedings and this them she won’t be lucky..
This is when you realise what absolute power can do and Education is important.
Or perhaps riots are absolutely inevitable, because there is just no justification for this level of incompetence.
Ace Magashule used to say “batho ba tla tsamaya ka thoko ho lieta”, and the 7th Administration is leaning into the true meaning of: we are not our grandparents, who would simply fold.
People are no longer prepared to accept leaders who fail dismally at basic governance issues that require nothing more than the bare minimum.
Will there be consequence management or will the appeal be activated?
