Bloemfontein – State Attorney’s Adv E. Baloyi-Mere SC has recommended dismissal in the disciplinary proceedings against Mosa Masemene, head of department at Human Settlements.
Baloyi-Mere who chaired the proceedings delivered judgment on Friday, 31 October 2025 after finding Masemene guilty on all charges.
Sources close to Masemene say Advocate Lawrance Manye, the prosecutor told her Free State Provincial Government does not have a case and Manye alleged told Masemene the same thing.
According to the judgment in our possession Masemene faced three charges related to the withdrawal of charges against Khaya Radebe, PSC report, and the SABC interview.
A labour expert who spoke on condition of anonymity said “final written warning” would have been enough.

Masemene was represented by Andrew Botha from Peyper Attorneys.
Insiders say the chairperson of the hearing did not afford parties an opportunity for litigation and mitigation before handing judgment.
