“This is nonsense” – Furious Employees react to forced leave imposed by Community Safety, Roads, and Transport

Bloemfontein – The employees at Community Safety, Roads, and Transport are up in arms over forced leave imposed by department.

A text sent by IT department instructing employees to take leave from 27 – 31 December 2024, has been received with anger.

STEPUPSANEWS can confirm this instruction is in violation of Determination & Directives On Leave Of Absence In The Public Service.

In terms of paragraph 5.1 of the Determination and Directive on the Leave of Absence issued by the Minister of Public Service and Administration, employees are entitled to annual leave with full pay during each leave cycle of 12 months starting from January of each year.

The meaning of paragraph 5.1 is that an employee with more than 10 years of service is entitled to 30 days annually leave in an annual leave cycle starting from January to December of each year.

Labour Law expert who spoke on condition of anonymity said employees can’t take leave in advance.

“It therefore means that if his leave days are exhausted in 2024 leave cycle, an employee cannot utilize leave credits for 2025 in advance in 2024.

There is also no provision in the Determination and Directive on the Leave of Absence that allows employees to utilize their leave credits of future Annual leave cycle in the current Annual leave cycle (i.e. Utilizing leave days for 2025 cycle in 2024 cycle) The above paragraphs are under Part 4 of the Determination and Directive on the Leave of Absence”

She continued by quoting the determination and directive (leave should be planned and initiated by an employee).

“5.2. Annual leave should be planned and scheduled at least at the start of a leave cycle, i.e. January of each year.”

“5.7. An employee must submit his/her application for annual leave in advance, unless unforeseen circumstances prevent him/her from doing so.”

Furious employees said this is nonsense.

“This is nonsense, this is not going to work at this short notice.

What must we do with plans we have for our leave days with families?”

Another employee said the department is led by clueless people.

“We are led by clueless people, they don’t even read.

How do you expect this department to function optimally when top management does not even know provisions of public service.

They keep on exposing themselves. If they are not charging staff frivolously, they transfer staff without consultation, or worse, dismiss staff for no apparent reason while the department is collapsing”
