Bloemfontein – The Public Service Association (PSA) has drawn the line in sand for Free State Gambling Liquor & Tourism Authority (FSGLTA) over its failure to implement Commission for Conciliation, Mediation and Arbitration’s (CCMA) award.
This follows an enforcement award by Lucky Moloi on the 13 June 2025.
Cindy Dickens, Commissioner at CCMA had ruled in favor of Magashule on 15 November 2024 that Magashule must return to work on the 2 December 2024 and be paid.
PUBLIC SERVICE ASSOCIATION
A letter dated 30 September 2025, from Reuben Maleka sent to Obakeng Seseane, acting CEO, Jack Tladi, Board chair, Ganyani Chauke, acting Deputy State Attorney, and Duma Skosana, Chief Financial Officer (CFO) sets the tone of what action the association is to take.
“Pursuant to section 143(1) and (3) of labour Relations Act, an arbitration award may be enforced as of it were an order of the Labour Court, provided that the Director has certified the award.
In light of the foregoing, arbitration award is now regarded as an Order of Court, in accordance with Public Service Act.
The CEO bears ultimate responsibility, as the Executive Authority, for the execution of functions by the officials of the company.
The PSA mandates that the award be executed by 7 October 2025, should this not occur, we will seek the intervention of the Sheriff to enforce the award.”
