MAP to accept concourt judgment and begin search for a new CFO

Qwaqwa – The troubled Maluti-A-Phofung local municipality will resolve to accept to concourt “refusal to grant leave of appeal” in the matter brought by, Jemina Mazinyo, the municipality’s Chief Financial Officer.

Leaked agenda of the council meeting held on the 7 November 2024, paints a detailed picture, although the item was postponed.

The council will resolve:

It is recommended that:

Council takes note of constitutional court judgment
Council abides by the decision of the court
Council recover if access salaries to the incumbents, in full, in line with Bloemfontein High Court order
Internal Audit to determine the exact amount owed to the municipality by both officials and report back to council
The immediate release of the CFO and appoint an acting CFO

The constitution court refused to “grant leave of appeal” on 23 October 2023 and 14 months later, only then, the council will resolve to accept the judgment.

Who will account for the salary paid to Mazinyo from the day Concourt (23 October 2023) made a ruling to her last day in office?

Her salary of R1 596 747.00 per annum, which was overly paid as the municipality paid her in a wrong category(6) instead of (4) where MAP is currently placed remains another thorn.

A salary for category 4 is R1223,632 at (maximum point) but she was supposed to be paid R932 548.00 (entry level of category 4) according to the Free State High court.

The followed the application launched by erstwhile MEC of COGTA Mxolisi Dukwana over the appointments of CFO and Patric Mothamaha, Municipal Manager who has since left the municipality.

The Free State High court declared the appointment of both Mazinyo and Mothamaha unlawful and ordered monies paid to both Mazinyo and Mothamaha be paid back to the municipality.

Mothamaha was also paid at maximum level of (category 6) with annual salary of R1.987,402 instead of R1 160 847.00 as per the court papers.

Mothamaha has since been replaced by Advocate Motsoahae Mofokeng as Municipal Manager.

Will Mazinyo see her contract out in March 2025 or the municipality will kick her out?
