Bargaining Council ordered Community Safety to reinstate employees with back pay

Bloemfontein – The General Public Sector Bargaining Council (GPSBC) has dealt Community Safety, Roads, and Transport a bloody blow after declaring the dismissal of Lawrance Msinto, procedurally unfair, and ordering his reinstatement with back pay.

This is after Lawrance Msinto through his Union, POPCRU challenged the department’s decision to dismiss him over alleged absconding.

Sekonyela Moeketsi Moeketsi, commissioner at GPSBC poked holes in the department’s arguments that the bargaining council didn’t have jurisdiction.

Dealing with the case, Sekonyela said the department knew at all material times where Msinto was as he has been communicating with his line managers.

Strangely, the department retracted its dismissal letter of few months earlier before giving Msinto another dismissal letter stating absconding on the 6 June 2023.

As soon as she was sworn in as MEC staff at CSPR were charged, dismissed and, lucky ones were transferred.

There is another staff member who was dismissed similarly to Msinto and we also have evidence that his line manager knew his whereabouts at all times.
