Mtakati case law: Will Hods take on Premier or bend over?

Bloemfontein – The imminent reshuffling of the Head of Departments hardly two months after the newly sworn Premier, Joyce Mathae is likely to end in courts.

This follows a meeting in which the Premier referred a HoD who said she would take her to court if she is reshuffled.

In the same meeting, the Premier alleged that HoD does not come to work on Mondays and Fridays.

Since then, at every given opportunity, the Premier allegedly mentions people taking her to court over the reshuffling indicating she is rattled.

Premier Sefora Ntombela tried this, but it backfired and Sipho Mtakati took her to court and won, he was eventually given a very golden handshake.

Mtakati was suspended after the transfer failed and he got paid while chilling at home.

Mtakati was represented by Advocate Matlho or Matlho Attorneys who will most probably eyeing these developments with interests.

At the time, Ntombela was facing Mtakati only but now, no less than 5 HoDs are gearing up to take Mathae to court using Mtakati judgment which set a precedence.

Can she suspend all hods refusing to transferred or will she opt buying out?

With Mathae adopting Lefusism, a term developed recently in what socialists say it means “being busy doing nothing” or “popularism”, it remains to be seen if she is better than erstwhile Premier Mxolisi Dukwana.

According to the Public Service Act, a transfer of this subsection may only occur if:

  • The relevant head of department consents to the transfer, or
  • After due consideration of any presentation by the head, the transfer is in the public interest.

Only the above play a key in transferring of HODs and not even deployment committee resolutions of the party as it does not exist in law.

The days of ruling government as tuckshop are over, the Government of National Unity is showing OR Tambo people flames in the national departments and voters have spoken.
