MAP municipality caught huffing and puffing by Concourt

Qwaqwa – The troubled Maluti-A-Phofung is yet again in the spot light not because if water, electricity, service delivery nor protests, but for what many view as contempt of court.

This after the seven judges of constitutional court dismissed a “leave to appeal” application by Jemena Mazinyo in October 2023.

Mazinyo had sought audience from the highest court after Free State High judges declared the appointment of Patrick Mothamaga, the erstwhile Municipal Manager, and Mazinyo as Chief Financial Officer unlawful and irregular.

“The appointment of the third respondent as Chief Financial Officer/a manager directly accountable to the Municipal Manager, by the second respondent and the resultant contract in March 2020 and on a salary of R1 596 747.00 per annum, is declared to be unlawful and irregular and set aside.

The pair were paid in line with a Category 6 Municipality classification instead of category 4 which MAP fell under at the time of their appointments.

At heart of this, was Mxolisi Dukwana former MEC for COGTA who launched an application to have the positions set aside, declared unlawful and irregular.

Despite the Concourt ruling in October 2023, STEPUPSANEWS can confirm the CFO is still in office.

It’s also not clear monies paid to the duo have been recovered as ordered by the court and why the CFO is still in office.

Saki Mokoena, newly appointed MEC for COGTA and Human Settlement , and Malekula Melato, newly elected Executive Mayor of Maluti-A-Phofung municipality couldn’t be reached for their comments.
