Social Dev bitten the bargaining council’s dust at least twice before multimillion blow

Bloemfontein – The multimillion labour court judgment handed last month against Social Development in Free State is a demonstration of perpetual impunity.

This after labour court dismissed departments application that sued to challenge bargaining council judgment that declared the appointment of Dibolelo Mance unlawful.

Anna Maria-Fourie, Commissioner found Freddy Finder an unreliable witness and Mance’s political ties with ANC key to her appointment.

R120 MILLION LITIGATION

In 2020, Free State high court judge Daffue ruled in favour of 1400 NPOs in the R120 million lawsuit.

The department sought legal advice and it was advised not to review the judgment.

UNLAWFUL SUSPENSIONS

Advocate Ntlhare and Thabo Mahlaba were unlawfully suspended, took the department to bargaining council and won.

The department paid them thousands but that’s not all, legal costs were also paid by the department.

Mahlaba was charged for R434 158.80 of irregular expenditure .

However, a copy of the report approved by Phahlo recommended disciplinary action against:
F. Finger: Director Human Resources
L. Roosouw: Deputy Director

To date, none the two were ever charged or at least who benefited unduly, it’s interesting why Auditor General has not reported this to the Hawks like they did with Health.

The report in question was approved by Phahlo but he went to charge someone but implicated officials.

COURT APPLICATION
The department took its employee to court in an effort to declare her appointment unlawful and set it aside.

This application according to documents was initiated by Advocate Jacob Phahlo, former acting HOD and it was withdrawn when he was on sick leave.

Social Development has been a playground for imputy and in the next weeks we will show with documentatary evidence how rotten this department is.

We will also look at the panel that was in charge of that infamous appointment of Mance.

At Social Development an Advocate is an assistant director while a matriculant is a deputy director, let that sink in.
