Bloemfontein – Department of Community Safety, Roads, and Safety suffered another loss after bargaining council dismissed it’s application.
This after Papi Masilo, former Chief Director: Provincial Secretariat who was dismissed during a disciplinary hearing took the department to bargaining council over “unfair dismissal”.
Masilo was served with dismissal letter on the 9 April 2024, before conclusion of his hearing after his representatives asked for a copy of the acting letter and delegated powers of Dr Masego Tshabalala.

While waiting for response, Masilo was served with a dismissal letter signed by Tshabalala.
CONFUSION
On the 12 April 2024, three days after Tshabala sent a dismissal letter, NA Matiwane, chairperson of the disciplinary hearing found Masilo not GUILTY.

After Masilo challenged his dismissal Tshabalala asked labour court to declare the appointment of Masilo “irregular”, at that time Masilo was no longer their employee as she has dismissed him.
Tshabalala went further and argued bargaining council had no jurisdiction over this matter.
Commissioner Sekonyela Moeketsi MoeketsI dismissed department’s application and bargaining council will listen to the application brought by Masilo.
While Masilo will know his fate in due course, Mohammed Ismail, Chief Director: Fleet is still suspended having been served by Tshabalala with suspension letter in the 15 August 2023.
In essence, Masilo got charged, dismissed, is likely to be reinstated and compensated fully while Ismail is still suspended.
TSHIDI MOHAI
In 2024 Public Service Commission found the transfer of TSHIDI Mohai to be irregular and recommended she return to her position.
The department claimed to have assessed her “competence” but failed to provide details of “skills expertise”.
The department am under Tshabalala lost another case after dismissing an employee.
