Nasrec The chairperson of Public Service Commission Dr Somadoda Fikeni has warned accounting officers of dangers taking unlawful instructions.
This in response to the ongoing Madlamga Commission of Inquiry after Fani Masemola, National Police Commissioner told the Justice Madlanga the instruction by suspended Police Minister, Senzo Mchunu to disband the Political Killings Task Team was “encroaching”.
Masemola whose testimony took two days said Minister’s Chirf of staff sent an email on the 31 December 2025, when he was on annual leave.
Asked by Justice Madlanga what would he do if he would defy the Minister if given any instruction that’s not policy related but operational, Masemola said “it depends” which prompted Justice Madlanga to probe further.
Dr Somadoda Fikeni, chairperson of Public Service Commission said any public servant taking unalwful instructions can’t be absolved from accountability.
He urged public servants to request politicians to either give instructions in writing or seek legal opinion failing which, they can bring in PSC.
Maybe he is talking about PSC in other provinces, not Free State office.

In Free State Executive Authorities and their office managers give instructions to Head of Departments and they just implement without asking questions let alone resisting.
This includes suspensions, dismissals, employments and tenders.
