Msinto drags Community Safety, Roads, and Transport to Labor court

Bloemfontein – The Labor court will on Thursday hear an application by Rankele Msinto against his employer, Department of Community Safety, Roads, and Transport (CSR&T) over its failure to reinstate him after bargaining council ruled in his favor.

Msinto will be represented by Advocate Johan Nysschens of Johan Nysschens Attorneys.

Nysschens has been part of the legal team of several reported and ground breaking judgments and has in excess of 14 years of experience in commercial and labour litigation.

This is after the Bargaining Council ruled in favor of Msinto last year and ordered the department to reinstate him and financial compensation dating back to the day he was dismissed, 6 June 2023.

Msinto was fired twice, on the 16 May 2023 and 6 June 2023, however, the dismissal letter of May was retracted and replaced by June dismissal for absconding a year earlier, in September 2022.

While the department claimed Msinto absconded, evidence showed Msinto otherwise.

Regardless of the evidence at its disposal, Msinto was dismissed.

Sekonya Moeketsi, commissioner at bargaining council found it surprising that the department claimed Msinto absconded.

After Bargaining Council ruled of POPCRU on behalf Msinto, the head of Department, Dr Masego Tshabalala not State Attorney, barred Msinto from returning to work claiming it’s reviewing the order.

The six weeks review period lapsed and only after court papers were served the department started review process after six months.
