Bloemfontein – The judgment by the Free State High Court acting Judge Mahlangu proves what Kopung Ralikontsane, the outgoing Director-General of the Free State Provincial Government said.
Ralikontsane who was addressing planning and budgeting EXCO Lekgotla on 27 February 2022, warned the Heads of Departments not to take illegal instructions from politicians.
This was after HODs had complained to him that the HAWKS were harassing them.
Ralikontsane was allegedly interrupted by Makalo Mohale, the then MEC for DESTEA and Ralikontsane lost his calm telling Mohale where to get off.
Exactly 30 months after Ralikontsane sent that string message, both Joyce Mathae, Free State Premier, and Adv Jacob Phahlo are set to face the music for ignoring an interim court order issued on 8 August 2024.
Just like Ralikontsane had prophetically warned HoDs that they would be in trouble for taking unlawful instructions, Phahlo will be appearing before the Free State High Court on 5 September 2024 for contempt.
Below is extracts from a letter written to ANC comrades:
- The court must have issued an order depending on the existing circumstances and there must be proof of this;
Secondly, there must be significant proof rather than a minor oversight that the individual disobeyed the court order;
The alleging party (HOD) for contempt, will mean that has proved without reasonable doubt the offense was committed;
Thirdly, there must be wilful disobedience, which will be more of a deliberate action to refuse to obey the law or order;
This seems to be the case with the Premier and HOD: Social Development;
It must further be noted that it goes beyond forgetfulness or negligence,
but a deliberate act of defiance;
The Premier and HOD: Social Development have willingly and
intentionally disregarded the court order;
It is, of course, no doubt that the court order has been brought to the
attention of the Premier and HOD: Social Development and they were both
aware of the implications;
While the ANC is running circles on what do with their Premier, we will be running count down daily till day 0 which will be the 5 September 2024.
This should serve as warning to those who take instructions without asking and challenging them, just like Dr Takiso Masiteng said at the Zondo Commission.
