ANC members take the party to court in Free State and Eastern Cape  

The disgruntled members of the African National Congress in the Mangaung Region, Free State have kept their promise and taken the party to court.
 
This followed the letter dated 16 May 2022 the group sent to party Treasurer-General Paul Mashatile, ANC NEC member Nomvula Mokonyane, and the Free State IPC coordinator Paseka Nompondo signed by Mokhutlo, it states that the term of office of the IPC expired in March 2022.
 
The Supreme Court of Appeal (SCA) declared the elective conference of May 2018 irregular and unconstitutional. The SCA found that the elective conference was riddled with irregularities. This ruling was favorable to disgruntled ANC members aligned with Cyril Ramaphosa, leading to the appointment of the IPC. 
“We inform you that we request a response to this letter and our memorandum by the 18th May 2022, 17:00, failing which we shall have no option but to approach the high court on an urgent basis to seek relief as requested,” according to the letter. 
 
True to their word they have now taken the ANC to court and the applicants are:
Ditaba Mokhutle
Nozenza Cezula and
Thabiso Seliane
 
The respondents are:
African National Congress (ANC)
Acting Secretary-General, ANC
Treasurer General, ANC
Interim Provincial Committee (IPC)
Coordinator, Interim Regional Committee (IRC) Mangaung Region
Convener, IRC Mangaung Region
and Branches of the ANC in Free State
 
According to the notice of the motion, the crux of the matter seems to be the IPC which according to the applicants is beyond its term which allegedly expired in March 2022, and the appointment of the IRC in the Mangaung Region by the IPC.
 
They asked the court to among others declare the current IPC unlawful and a new IPC or Provincial Task team be established until the Provincial Executive Committee is established.
 
 
In other news, Ondelwa Sokomani and many others of Nonyamezle Mxenge Branch (Ward 22)in WB Rubusana Region in Eastern Cape have asked the newly elected Eastern Cape Provincial Executive Committee to be nullified and dissolved failing which they will go to court. They have given the ANC till 25 June 2022 to respond.
 
Through their lawyer, Makangela Mtungani the group allege branches in WB Rubusana, Chris Hani, and OR Tambo were barred and the lists were unceremoniously changed.
